Publix, the largest grocery store chain in Florida, will now follow the state’s procedures with its open carry policy.
On Sept. 10, a panel of the 1st District Court of Appeal (DCA) overturned a 1987 law that made it a misdemeanor to visibly display guns, according to Florida Attorney General James Uthmeier. The ruling does permit private business owners to “compel individuals carrying firearms to leave their premises,” Uthmeier wrote.
Weeks later, on Sept. 25, Florida put its statewide open carry policy into effect.
“As of Sept. 25, 2025, Florida law allows the open carry of firearms. Publix follows all federal, state and local laws,” a Publix spokesperson told NBC affiliate News Channel 8 and the South Florida Sun Sentinel.
“In any instance where a customer creates a threatening, erratic or dangerous shopping experience — whether they are openly carrying a firearm or not — we will engage local law enforcement to protect our customers and associates,” the Publix spokesperson’s statement continued.

The grocery chain is the largest in the state, with more than 900 stores, according to the Sun Sentinel. The outlet reached out to eight Publix stores in South Florida, including stores in Fort Lauderdale, Hollywood, Davie, Miramar, Boca Raton, Delray Beach, Coral Gables and Homestead, and all confirmed they are allowing open carry due to the recent DCA ruling.

While Publix will permit open carrying guns in their Florida locations, a number of other retail stores maintain that they will prohibit customers from open carrying. Walmart, Winn Dixie, Harveys and Fresco y Más have all issued statements regarding their concealed carry policies, per NBC 6 South Florida. Some Walmart locations previously sold weapons and ammunition.
“Our priority is creating a safe and welcoming shopping experience for all customers and associates,” Southeastern Grocers, the parent company of Win-Dixie, Harveys and Fresco y Más, said in a statement to NBC 6 South Florida. “As a private business, our policy remains unchanged: we do not permit open carry of firearms inside our Harveys Supermarket and Winn-Dixie stores. We respectfully ask customers to secure firearms safely before entering, and we appreciate the continued cooperation that helps us maintain an environment where everyone feels comfortable.”
Walmart’s policy on its website reads”Motivated by our desire to create a safe environment in our stores and clubs, we request that customers no longer openly carry firearms into Walmart or Sam’s Club locations in states where open carry is permitted – unless they are authorized law enforcement.”
“As of September 2019, we are working to create and display new signage to help communicate this policy,” the Walmart statement continues. “We will continue to follow state and local laws regarding concealed carry permit holders.”

Other stores, including Cotsco and Target, have a no-gun policy — including both open and concealed carry.
“I don’t like when there is confusion out there because it leads often to mistakes and bad things happening,” Parkland state Rep. Christine Hunchofsky told NBC 6 South Florida. “I wish we would do more to make it clearer something we can do in the legislature; it’s a pretty easy fix.”
